Biography
Alan Fox has more than 35 years of experience representing property owners in a variety of real estate transactions, from small purchases and sales to blanket mortgages of scores of properties involving tens of millions of dollars. He represents a range of clients, including banks, businesses, economic development agencies, municipalities, and individuals. Alan is a member of the firm’s Real Estate + Development Group.
New York Economic Development Tax Incentives
As counsel to New York Industrial Development Agencies (IDAs) and Local Development Corporations (LDCs), with experience representing applicants before similar agencies, Alan is familiar with the tax incentives available to businesses that relocate to, or remain in, New York State. This perspective enables him to identify opportunities to reduce commercial clients’ costs when they want to relocate or expand. Where IDA or LDC bonds are a financing option, such as in connection with capital projects of not-for-profit entities, he has the experience to guide a client through this process. He has represented industrial development agencies in the New York metropolitan area in connection with incentive projects for commercial and residential development. In one of Alan's cases, his assistance helped bring a new pharmaceutical company to a municipality, resulting in the construction of three new buildings and retention or creation of 600 jobs.
Real Estate - Finance
Alan represents borrowers and lenders in connection with commercial mortgage financings in New York and nationwide. He drafts and negotiates commercial mortgage loan documents and provides advice regarding mortgage laws. Alan is part of a team that represents a major affordable housing lender for its financing needs across the country. He has handled the refinancing of office, commercial, and residential properties, including multifamily garden apartment developments and hotels.
Real Estate – Transactions
Alan represents purchasers and sellers of real property in New York City and across New York State. He has represented purchasers and sellers, landlords and tenants. His transactions have included ground leases, the site acquisition for development of a major league sports training facility, and the purchase and sale of shopping centers, high-rise office buildings, and apartment towers. Alan drafts and negotiates purchase and sale agreements, and advises clients on all issues related to the purchase or sale of businesses. He recently guided a real estate company through the acquisition of medical office complexes in Long Island, and handled the sale of an industrial laundry facility in the Bronx to the City of New York.
