  • Overview


    Gabrielle Mercadante defends insurance, personal injury, and commercial litigation matters on behalf of clients, including insurance companies, airlines, general contractors, and large corporations. She is a member of the firm’s Insurance + Reinsurance Group and is fluent in Spanish.

    Insurance Litigation

    Gabrielle represents insurance companies in claims arising out of coverage issues. She counsels carriers in all stages of disputes, from providing advice on coverage obligations to representing them at mediation and trial. Specifically, Gabrielle has managed hundreds of first-party insurance disputes on behalf of Florida’s largest homeowners’ insurers. She has also litigated bad faith claims and defended insurance companies in class actions brought under the Medicare Secondary Payer Act. She routinely obtains positive outcomes for her clients, including winning dispositive motions and securing favorable settlements and jury verdicts.

    Business Litigation

    Gabrielle represents commercial clients in various industries, from construction to aviation, in a variety of disputes. She helps clients facing claims such as breach of contract, negligence, personal injury, and fraud, and has extensive experience litigating these claims. Gabrielle has defended global commercial airlines in damages-based lawsuits stemming from a variety of aviation-related incidents. In addition, she has represented general contractors and their insurers in construction defect claims relating to residential and commercial construction, from pre-suit matters throughout the litigation process.

    Pro Bono

    Gabrielle is committed to doing pro bono work, and her efforts have included representing an elderly woman in connection with the fraudulent transfer of her home.

    Prior to joining Robinson+Cole, Gabrielle practiced insurance, personal injury, and commercial law at firms in Miami and Fort Lauderdale, where she litigated cases involving complex commercial transactions, insurance disputes, aviation accidents, and construction defect claims.

      • Managing hundreds of first-party insurance disputes on behalf of Florida’s largest homeowners’ insurance companies, handling all aspects of cases, from initial file assessment, to discovery matters, through motion practice, mediation and trial.  

      • Obtained favorable verdicts for property insurer after lengthy jury trials in first-party disputes. *

      • Won numerous motions for summary judgment for residential property insurer in cases involving covered claims, where the insureds failed to use the insurance proceeds to make repairs. *

      • Defended a major global airline primarily in federal court, in damages-based lawsuits stemming from aviation accidents, alleged negligence, defamation, and discrimination claims, as well as personal injury suits. * 

      • Won a motion to dismiss in a negligence case filed against major global airline in federal court, where it was alleged that the airline failed to provide a passenger with requested wheelchair assistance. *

      • Defended general contractors in construction defect claims relating to multi-million dollar construction matters, from pre-suit through litigation. * 

      • Obtained a favorable settlement in favor of a major global airline that was sued for allegedly refusing a passenger’s emotional support animal to board the aircraft. *

      • Briefed choice-of-law issues for an international restaurant chain sued in a wrongful death action. *
