    Biography

    Brian Wheelin, a member of the firm's Business Litigation Group, has significant experience litigating and arbitrating a variety of complex business and real estate disputes. He is a trial lawyer who has handled over twenty jury and bench trials. His recent trial successes include obtaining defense verdicts of a multi-million dollar fraudulent transfer claim and alleged misrepresentations surrounding the acquisition of a chemical plant.   Brian also regularly argues appeals before the United States Second Circuit and state appellate courts in Connecticut and New York. He represents a range of clients, including Fortune 500 companies, lenders, developers, and Real Estate Investment Trusts (REITs).

    Real Estate Litigation

    Brian handles litigation which arises in the real estate context, such as commercial lease disputes, title insurance matters, claims against condominium associations and commercial foreclosures. He has obtained successful results for clients, such as defeating an injunction looking to prevent a developer from re-opening a Connecticut highway rest stop. He recently assisted a condominium association with disbursing nearly $2 million in insurance proceeds to unit owners following a fire. Brian serves on the firm's Real Estate and Title Insurance Litigation Committee.

    Litigation Management and Electronic Discovery

    Brian has served as national litigation counsel for several clients. He manages outside counsel in an effort to ensure cost-effective results. He successfully managed claims brought by over 500 plaintiffs in several courts involving a train derailment in West Virginia.

    He is also the firm’s Electronic Discovery partner. Brian works creatively with clients to devise proactive, cost-efficient and defensive e-discovery strategies.

    Commercial and Business Disputes

    Brian assists clients with a broad range of commercial litigation matters including contract disputes, fraud and intercompany claims. He has counseled clients in compliance with subpoena and governmental inquiries that, when unavoidable, have involved substantial document productions. Brian has routinely obtained dismissal of claims against his clients in advance of trial.

    He has served as pro bono counsel, and has been active on the boards of non-profit organizations in the Stamford, Connecticut area. The Connecticut Law Tribune honored Brian as one of its New Leaders in the Law in 2016. He was also selected to the Connecticut Super Lawyers list from 2022 to 2022 as a Rising Star to the Connecticut Super Lawyers list from 2012 to 2019.

      • Obtained judgment in New York federal court representing entirety of earnout due to client from sale of business after obtaining summary judgment on all of buyer’s fraud claims.

         

      • Defense verdict in New York state court for Fortune 500 company on multi-million dollar fraudulent transfer claim brought by law firm.

         

      • Defeated efforts to enjoin developer from re-opening most profitable rest stop in Connecticut after three-day injunction hearing.

      • Defense verdict for alleged breaches of representations and warranties contained in asset purchase agreement from sale of fluorine chemical business at Arkansas plant where claimed damages exceeded $5 million.

      • Defended Taiwanese corporation in California arbitration against multimillion-dollar claim of wrongdoing resulting from client's acquisition of semiconductor chip-testing assets.

      • Obtained dismissal of all claims brought by an airline passenger alleging wrongdoing on a international flight on a pre-discovery motion to dismiss. 

      • Obtained summary judgment for Fortune 500 company in defense of claims that client had a continuing obligation to provide access to its wastewater treatment facilities, fire suppression system, and parking lot for plaintiff's use of an adjacent commercial property.
      • Successfully defeated a Second Circuit appeal challenging the denial of prejudgment interest, saving an individual client over $1 million in claimed interest.

      • Defended an individual client in a bench trial against claims challenging his ownership interest in a high-end Greenwich property.
      • Obtained defense verdict after bench trial on insured's bad faith claims.

      • Represented condominium association in disbursing nearly $2 million in insurance proceeds obtained as a result of a fire. 

      • Defended major corporation at jury trial against claims brought by employee that he was entitled to certain stock option benefits.*
      • Obtained summary judgment (affirmed by Second Circuit) for individual clients against a claim that they guaranteed $600,000 of a multi-million dollar debt owed by a defunct entity.

      • Obtained summary judgment for corporate client against plaintiff's alleged trade secret misappropriation and copyright infringement claims relating to a software program used by client for the processing of insurance applications. After summary judgment was granted in favor of client, the case proceeded to a jury trial against the other defendants, where the plaintiffs were awarded $26 million, in addition to other relief.*
      • Defeated appeal by guarantor on issue of first impression pertaining to deficiency judgment. 

      • Successfully managed claims brought by over 450 plaintiffs in four separate lawsuits pertaining to train derailment in West Virginia. 

      • Routinely represent lenders foreclose on commercial properties including $265 million mortgage on commercial office building in Stamford, Connecticut. 

      • Obtained summary judgment on tenant’s multi-million dollar claims of lost business relative to disruption at commercial premises in Greenwich.
